These Terms of Purchase govern the purchase of physical products (including printed cookbooks and branded merchandise) and digital products (including digital cookbooks, downloadable guides, templates, and similar digital files) from Cimini Creations LLC d/b/a My Weathered Table (“My Weathered Table,” “we,” “us,” or “our”) through our website and any related online sales channels directed to customers in the United States. All service‑based work (including recipe development, editorial food photography, AI strategy and workflow consulting, and other collaborations described on our Collaboration and Services page) is provided by Cimini Creations LLC under separate written service agreements with the applicable client and is not governed by these Terms of Purchase.
By placing an order for a physical product, you agree to these Terms of Purchase.
1. Seller; Products; Eligibility
My Weathered Table is operated by Cimini Creations LLC, an Arizona limited liability company. For purposes of these Terms of Purchase, “products” means the physical goods we offer from time to time, such as printed cookbooks and branded merchandise.
2. Digital Products
If we offer digital products (such as digital cookbooks, PDF downloads, or downloadable templates), the following additional terms apply to those purchases:
(a) Delivery. Digital products are delivered electronically. Upon confirmed payment, you will receive access or a download link via email or through our website. We are not responsible for your inability to access a digital file due to your device, software, or internet connection.
(b) No Refunds. Because digital products are delivered immediately upon purchase and cannot be "returned," all sales of digital products are final. We will, however, work to resolve issues caused by a defective or inaccessible file.
(c) Personal Use License. Unless otherwise stated at checkout, purchase of a digital product grants you a personal, non-exclusive, non-transferable license to use the file for your own personal or internal business use. You may not reproduce, resell, redistribute, share, sublicense, or use any digital product for commercial purposes without our prior written consent.
(d) No Unauthorized Sharing. You may not share your download link or file access with others. Each purchase is licensed to one user.
You may place an order only if you are at least 18 years of age and legally able to enter into a binding contract. If you place an order on behalf of another person or organization, you represent that you have authority to bind that person or organization to these Terms of Purchase.
2. Orders; Acceptance; Availability
Placing items in a cart or commencing checkout does not create a binding contract. Your order is an offer to purchase the selected product(s) under these Terms of Purchase. We may accept or decline any order in our sole discretion.
An order is accepted only when we (a) send a written order confirmation, or (b) receive payment and begin processing or shipping the order. All products are offered in limited quantities and may become unavailable without notice. We may cancel all or part of an order, including for unavailability, errors in pricing or description, suspected fraud, or incomplete or inaccurate information. If we cancel after receiving payment, we will refund the amount paid for the canceled portion of the order.
3. Pricing; Taxes
Prices are listed in U.S. dollars and may be changed at any time before order acceptance. Prices do not include applicable taxes, shipping, or handling unless expressly stated.
If a product is listed at an incorrect price or with materially incorrect information due to a typographical, technical, or other error, we may cancel the affected order and refund any amount paid for that order or item.
You are responsible for any sales, use, or similar taxes imposed on your purchase, other than taxes on our net income. Where required by law, we will collect and remit applicable sales tax. If tax is not collected at checkout, you remain responsible for any tax legally due.
4. Payment
Unless we state otherwise at checkout, payment for physical products is currently accepted via Zelle or other methods as indicated at checkout and is received by Cimini Creations LLC. We may modify accepted payment methods at any time.
By submitting or initiating payment, you represent that you are authorized to use the selected payment method and that the information provided is accurate. We may wait to process or ship an order until payment is received and verified. Your bank, Zelle, or other payment service provider may impose their own terms, limits, security procedures, and fees, which are outside our control.
We are not responsible for payment delays, holds, reversals, or errors caused by banks or payment providers. Any such fees are separate from our product prices.
5. Shipping; Risk of Loss
Unless we expressly agree otherwise in writing, we ship physical products only within the United States to the shipping address you provide at checkout. Any stated processing or delivery time is an estimate only; we do not guarantee delivery dates.
You are responsible for providing a complete and accurate shipping address. If a shipment is returned due to an incorrect address, failed delivery attempts, or refusal of delivery, we may require additional shipping charges before reshipment.
Title to products and risk of loss pass to you when we deliver the products to the carrier, subject to any rights you may have under non-waivable consumer protection laws and any applicable carrier claims process.
6. Returns; Damaged or Incorrect Items
We want you to receive the products you ordered in good condition. If you receive a damaged item or the wrong item, contact us in writing within seven (7) days of delivery with your order details and, if possible, photographs of the issue.
Subject to applicable law and our verification of the issue, we may, in our discretion, (a) provide a replacement, (b) issue a refund, or (c) provide store credit. We may request that you return the item as a condition of resolution. If the issue is due to our error or a defective product, we will cover reasonable return shipping; otherwise, return shipping may be your responsibility.
Except where required by law, we are not obligated to accept returns for: (a) change of mind, (b) customer ordering errors, or (c) minor variations in color, appearance, or packaging. For printed cookbooks, food-adjacent materials, hygiene-sensitive items, personalized items, and limited-run merchandise, we may apply additional return limitations where permitted by law.

We make reasonable efforts to describe and depict products accurately, but actual colors, materials, and appearance may vary, including due to screen or device settings or small-batch variations.
You are responsible for using products only as intended and in accordance with any instructions, warnings, or care guidance provided. To the fullest extent permitted by law, we are not responsible for damage caused by misuse, improper care, modification, or use contrary to our instructions.
8. Disclaimers; Limitation of Liability
To the fullest extent permitted by Arizona law and other applicable law, products and related website sales functions are provided “as is” and “as available.” Except to the extent a warranty cannot be disclaimed, we disclaim all express or implied warranties, including implied warranties of merchantability, fitness for a particular purpose, and noninfringement, as well as any warranties arising from course of dealing or trade usage.
To the fullest extent permitted by law, Cimini Creations LLC d/b/a My Weathered Table and its owners, members, managers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to any product purchase or attempted purchase, including lost profits, lost revenue, or loss of business opportunity.
To the fullest extent permitted by law, our total aggregate liability for any claim arising out of or relating to a product order will not exceed the amount you actually paid for the specific product(s) giving rise to that claim. These limitations apply regardless of the legal theory asserted and even if we were advised that damages might occur. Some jurisdictions do not allow certain limitations; in that case, this section applies only to the extent permitted by applicable law.
9. Governing Law; Venue
These Terms of Purchase and any dispute arising out of or relating to them or to any product purchase are governed by the laws of the State of Arizona, without regard to its conflict of laws principles.
Subject to any non-waivable rights you may have under applicable law, any action or proceeding arising out of or relating to these Terms of Purchase or a product purchase must be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to the personal jurisdiction of those courts.
10. Changes; Entire Agreement
We may update these Terms of Purchase from time to time by posting a revised version with a new Effective Date. The version in effect on the date you submit your order governs that order, unless a different version is required by law.
These Terms of Purchase, together with any product-specific terms presented at checkout, constitute the entire agreement between you and Cimini Creations LLC d/b/a My Weathered Table regarding the purchase of physical products through our website and supersede any prior or contemporaneous understandings on that subject.
